Is Waterboarding Torture If Done To an American in Iran?

Lindsay Graham (R-SC) asked the military's legal adviser at Guantanamo Bay, Brigadier General Thomas W. Hartmann, if it would be torture for the Iranians to subject a downed American pilot to waterboarding. Hartmann flat-out refused to answer. Gee, I wonder why.
